RENTAL RULES & REGULATIONS

The Casa Botanica Antiparos Villas are available for bookings to the clients/guests for the sole purpose of tourist residential housing for the specific period booked and for no other use whatsoever, unless otherwise specifically agreed with the Owning Company.

A booking can be performed either directly by the Client via our website www.casabotanica.gr either via an external booking service provider or platform (for example: booking.com, trivago.com etc). Online bookings are confirmed immediately once you make your payment by credit or debit card, using our secure payment server.

It is your responsibility to ensure that you have carefully read the property and local area description and that you have selected the most appropriate property for your specific requirements. If you, or any of your Party, have any specific requirements or requests you are kindly prompted to contact us directly via our e-mail booking@casabotanica.gr before finalizing your booking.

We take reasonable care in providing our online booking platform via our website www.casabotanica.gr  but we can’t guarantee that everything on it is accurate (we update regularly). To the extent permitted by Law, we cannot be held responsible for any errors, any interruptions, or any missing bits of information - although we will do everything in our capacity to correct/fix them as soon as we can.

Bookings for accommodation and related agreements to be entered into between Casa Botanica Antiparos and the Guest to be accommodated shall be subject to these Terms and Conditions. Any particulars not provided herein shall be governed by laws and regulations and/or generally accepted practices. If the Hotel has entered into a special contract with the Guest insofar as such special contract does not violate laws and regulations and generally accepted practices the special contract shall take precedence over the provisions of these Terms and Conditions, n the preceding Paragraph

Notwithstanding the above, kindly note that booking and accommodation at the CASA BOTANICA ANTIPAROS are subject to the following booking conditions:

1. MINIMUM LETTING PERIOD

The standard accommodation period is 3 days (4 days, 3 nights).

Nonetheless, in the event that you wish to book with us for accommodation for a period shorter or longer than 1 week, you can book directly via our website. In any case, please feel free to contact us directly via e-mail to check our availability.

2. PAYMENT & BOOKING DEPOSIT

A. When you make a booking with us, you agree to pay the cost of your Holiday Rental, including any charges and taxes that may apply. Some of the prices you see may have been rounded to the nearest whole number. The price you pay will be based on the original, 'non-rounded' price (although the actual difference will be tiny anyway). Obvious errors and misprints are not binding. [For example: if you book a Villa that was mistakenly offered for €1,00, we may simply cancel that booking and refund anything you’ve paid].

You are kindly prompted, before you book your preferred Villa, to check our Payments Policy & our Refund Policy below.

B. We accept payment via the following methods of payment:

C. In the event you book one of our Villas directly via our website www.casabotanica.gr, besides filling out the online booking with all the required fields,  according to the time prior your check-in date the booking is performed, you will be asked to proceed to an advance payment of 50% of the Total Amount Payable (“onwards referred to as the “Booking Deposit”) For bookings made in a period shorter than 8 weeks from your check-in date the total amount of your holiday rental is payable upon booking.

If you have paid a Booking Deposit, the balance of the cost of your property is payable not less than 8 weeks before your check-in date, unless you are informed otherwise at the time of booking. This due date will be shown on the confirmation invoice and in your Secure Client Area on our website and a reminder will be sent to your registered email address in order for you to finalize your payment.

If you fail to pay the balance by the due date, we are entitled to assume that you wish to cancel your booking and we shall retain the Booking Deposit paid as the applicable cancellation charge in accordance with clause 4 of the present Term and Conditions

No obligation from Casa Botanica Antiparos exists until we have received the Booking Deposit in full and the Booking Form is duly filled by you.

Should you later cancel your booking, cancellation charges are applicable in accordance with paragraph 4 of the present Term and Conditions.

3. BOOKING CONFIRMATION DETAILS

Once your Booking Form is completed and your payment is made as stipulated above, you shall receive a Booking Confirmation from CASA BOTANICA ANTIPAROS by e-mail in the e-mail address you’ve stated in your booking form.

You are kindly requested to review this confirmation carefully and contact us immediately if the information contained therein is incorrect or incomplete.

Casa Botanica Antiparos shall not be obliged to rectify any errors or omissions that are reported more than 24 hours after transmitting the Final Booking Confirmation.

4. CANCELLATION BY YOU

All cancellations must be sent to us in writing by the signatory of the booking form.

In the event that you wish to cancel all or any part of your booking, the amounts paid to us are refunded as following:

-Booking takes place more than 8 weeks prior to check-in date

Cancellation Earlier than 8 weeks prior to check-in date

30% of your Booking Deposit paid is non-refundable

Cancellation Within 8 weeks prior to check-in date

Total amount of your Holiday Rental paid is non-refundable

-Booking takes place shorter than 8 weeks from check-in date

Total amount of your Holiday Rental paid is non-refundable

5. CANCELLATION OR ALTERATIONS BY US

Although it is unlikely that we will have to make any changes to confirmed arrangements, it could occasionally happen, and we will advise you to book a villa at the earliest possible date. If for any reason beyond our control we are unable to provide you with the property you have booked, we reserve the right to transfer you to a similar or better property. However, if this is not possible or you do not wish to be transferred, we will cancel the booking and refund in full any amount paid to us, but we will not be liable for any other cancellation charges for travel arrangements for you and/or your party.

Casa Botanica Antiparos reserves the right to cancel any reservation due to property damage or other forms of forced property unavailability (force majeure) and/or to move/change guests to other accommodation of an equal or better standard (if available) in the area.

In case of a cancellation due to external factors (Acts of God, Force Majeure), in no circumstance will Casa Botanica Antiparos be held liable for consequential damages of such a cancellation (ticket loss, extra charges, etc.) and no such claim(s) will be honoured.

6. NUMBER OF GUESTS

Only the maximum number of guests outlined in the booking form may use and reside at the property anytime (onwards referred to as the “Party”).

Should more persons than those stated are found to reside within the Villa, we will be entitled to ask you and your Party to vacate the property and cancel the booking overall, with 100% penalty of the holiday rental costs paid to us.

7. ARRIVAL AND DEPARTURE TIME

A. Unless otherwise stated on the Booking Confirmation or agreed upon with Casa Botanica Antiparos beforehand, Guest check in will take place at 15:00 pm on the Check-In Date (“Check-In Time”) and your check out will take place at 12:00 pm on the Check-Out Date (“Check-Out Time”). Check In or Check Outs outside of these hours are subject to availability and the written consent of casa Botanica Antiparos.

The Guests staying at the Villas shall be entitled to use the guest rooms from Check-In Time on the day of arrival to Check-Out Time on the next morning. However, if the Guest is accommodated continuously for some period, the Guest may occupy the guest room all day, except for the days of arrival and departure.

Notwithstanding the provisions prescribed in the preceding paragraph, we may permit the Guest to occupy the guest room beyond the time described above. In case of flight delays or inconvenience while travelling, you should contact us.

We cannot guarantee early check-ins or late check-outs unless confirmed by us in advance.

B. On Check-In Date a member of Casa Botanica Antiparos Team will meet you at your Villa at Check-In Time to deliver the keys, receive the Security Deposit via credit card (either remotely or in person), show you around the Villa, and deliver a welcome package containing useful information on the Villa and the island in general.

Correspondingly, on Check-Out Date a member of Casa Botanica Antiparos Team will meet you at your Villa at Check-Out Time to inspect the Villa, review the inventory, and collect the keys. You will be informed of any missing items or damage to the Villa discovered upon inspection at this time. Until the Villa and its keys are returned to Casa Botanica Antiparos’ satisfaction, Check-Out will be deemed not to have occurred and the charges stipulated hereunder shall apply. The Check-Out process generally takes around 30 minutes so please arrange departure plans accordingly.

Unless casa Botanica Antiparos has expressly agreed to a late Check-Out Time or reservation extension in writing, you shall be responsible for a charge of 50% of the effective daily rate on the Check-Out Date for staying past the Check-Out Time on the day of your departure. You will be charged for the costs of any such action against the credit card on your account. Casa Botanica Antiparos has full discretion to reduce this charge as deemed appropriate.

Should you stay past midnight on your Check-Out Date, you shall be liable for a DAILY charge equal to 100% of the effective daily rate on the Check-Out Date of your n for each day (or part Villa thereof) that you overstay, as well as any other damages, fees, or costs incurred by us, including, without limitation, legal fees incurred to regain possession of the Villa, as well as the loss of a subsequent booking or alternative Accommodations for any subsequent guest booked into the Villa for the time that you overstayed. Casa Botanica Antiparos has full discretion to reduce this charge as deemed appropriate.

8. SECURITY DEPOSITS

On the Check-In Date, casa Botanica Antiparos will pre-authorize and place a hold on your credit card for 10% of your Holiday Rental (onwards the “Security Deposit”). The Security Deposit varies by Villa and the exact amount will be communicated to you on the Booking Confirmation.

The Security Deposit is required to cover the cost of any damages to the Villa or its contents and/or any unpaid bills for extra services requested during your stay, which were not prepaid by you and/or included in your holiday costs. Casa Botanica Antiparos will be entitled to make charges against this hold in the event of any damage to the Accommodation or its contents, or a violation of rules outlined in the Present Terms & Conditions

Failing to pay the security deposit as stated in your e-booking form will prevent you from having access to the property at check-in, with 100% penalty of the holiday rental costs paid to us.

Examples of typical security deposit charges include, but are not limited to, the following:

• Replacement of broken appliances, TVs, audio or electrical equipment.

• Repair and/or replacement of damaged furniture, window blinds, doors, windows,

floors, bathroom showers, mirrors, wash basins, etc.

• Loss of house keys, TV or ceiling fan controls.

• Water replacement and system cleaning due to broken glasses inside the swimming

pool.

• Clean up services for stains and nail polish spills on furniture or sofas.

Failure to comply to these terms will/may result in the immediate termination of the leasing agreement, the forfeiture of the whole amount of the stay, excluding the security deposit amount if no damage is present, the forceful vacating of the property and personal contacts of the occupants.

This Security Deposit will be released in full under the following conditions after the satisfactory return of the Villa and its contents in the same material condition in which they were delivered on the Check-In Date as stipulated above. Provided that the Villa and its contents are returned in satisfactory condition, the Security Deposit will be released in full within five (5) business days of your scheduled Check-Out Date. Interest or reimbursement of any currency or transaction fees will not be refunded.

After any claims (duly documented to you) the Security Deposit will be refunded is refundable no later than 15 days from your departure the same way it was paid to us. In the exceptional case where the costs of repairing/replacing of any proven damages exceed the Security Deposit, the Guest accepts to cover the additional cost upon presentation of the relevant invoices.

A physical inspection of the Villa will be conducted, and the results of that inspection will be recorded prior to your Check-In Date. If you notice any damage to the Villa or its contents, you must notify Casa Botanica Antiparos, even if you regard the damage as minimal or normal wear and tear, or if you don’t believe the damage, is your fault. If you do not notify casa Botanica Antiparos of any such damage, you will be responsible for such damage on a repair or replacement-cost basis.

If damages or losses are found upon inspection during or after Check-Out Date, the cost to repair or replace such damages or losses shall be charged to your credit card or other method of payment pending the receipt of documentation duly evidencing the resulting repair or replacement costs, and the remaining amount of the security deposit will be returned to you. You waive any and all rights to contest Casa Botanica Antiparos charging your credit card upon your receipt of documented repair or replacement costs. Casa Botanica Antiparos is not responsible for any damage caused to or within the Villa, including without limitation, any broken, stolen or lost items – whether they be your property or that of the Villa itself.

If damages to the Villa or its contents exceed the amount of the Security Deposit, you shall be responsible for delivering to Casa Botanica Antiparos the funds necessary to fully repair such damages within five (5) business days of Casa Botanica Antiparos sending you the relevant estimates or receipts. You hereby expressly waive any right to object to any such estimates or receipts sent by Casa Botanica Antiparos. If you fail to pay the cost of the damages or losses within the specified time, you hereby expressly agree that Casa Botanica Antiparos shall be authorized to charge these costs to your credit card.

9. COMPLAINTS

We have checked each Villa to meet our guests’ high standards. The descriptions displayed on our website are accurate and made in good faith. We will do our very best to assist you and solve any problem occurs as soon as possible. If you have any problem during your stay, which cannot be satisfied by dealing directly with the property janitor, you should contact us immediately. Complaints lodged only at the end of the holiday period will not be taken into consideration. Clients who decide to leave the Villa earlier without our knowledge lose all rights to any eventual refund, compensation or rebate.

10. BEHAVIOUR & DAMAGES TO THE PROPERTY

By accepting the terms, you become also responsible for the correct and decent behavior of your Party. You are responsible for any loss or damage that you or members of your Party may cause to the property or its contents. You are required to report any damages to the property janitor or directly to us.

Changing the setting or decoration of the property (including furniture placement) without the prior consent of the Owner is not allowed.

Inside furnishings stay inside and outside furnishing outside! Rearranging the property can lead to cancellation of the booking and forfeiture of the whole stay and damage deposit amount. The Guest(s) is/(are) liable for any damage or for the removal/destruction of items on and around the property, including and not limited to plants, external structures, etc.

Guests are expected to respect the villas and their contents. Should you or any member of your party behave unrespectfully towards the property and its contents, the property owner or janitor has the right to ask all guests to vacate the property immediately, with 100% penalty of the holiday rental costs paid to us.

Villa items, including and not limited to linen and/ ornamental items should remain at the villas.

Guests are expected to use common sense and caution not to jeopardize the integrity of the buildings and structures or expose them to fire, explosives, flammable or pressurized liquids (e.g. scuba tanks, oxygen bottles, liquefied gas bottles, etc.). In case of such damage, guests will be held legally liable for such damages and charges shall be levied according to the Greek Judicial System. Guests are expected to use common sense in not disturbing neighbours or making noise during off-hours (14:30-18:00 and 23:00-08:00). The Owning Company will exert their right to terminate immediately a lease of a property without any reimbursement if official complaints are received for noise or drunken behaviour at ANY TIME.  The Owning Company cherishes our Guests’ safety and will do what is logical and humanly possible to safeguard it. In no case though will the Owner be responsible for accidents or Acts of God that may result in sickness, injury or death of one or more of the guests during their rental.  The Owning Company assumes no responsibility for accidents, injury, death or loss, including consequential damages from the rental and use of its properties. By sending in your booking deposit you, you agree by accepting this Agreement to fully legally waive any future claim against the Owning Company in case any such event occurs.

Do not use the Villas for purposes other than intended without authorization.

Do not light fire in the passage or Villas for heating or cooking.

The equipment and articles in the Villas are strictly meant for the guests staying in them. Hence, inside the guest rooms, use of such equipment and articles by outsiders is prohibited.

Be careful not to move the articles in the Villa you accommodate from their fixed places without permission.

Do not change the position of the gadgets, electric appliances and fixtures in the Villas without prior permission.

Do not bring the following inside the Casa Botanica Premises:

    • wild animals, birds, etc.

    • Things giving off foul smell

    • Articles exceeding the normal amount that can be carried into a hotel
      Guns, swords, etc.

    • Explosives, or articles containing volatile oils that may ignite or catch fire

    • Any other articles that may pose a threat to the safety of other guests staying in the Hotel

Do not scream, sing loudly, or create loud noises by any other actions inside Villas, as it may disturb your neighbors.

During your stay at the Villas, you and your guests are expected to comply with Greek law and respect quiet hours, which during the summer period (from April 1st to September 30th) are from 15:00 pm to 17:30 pm and from 23:00 pm to 07:00 am. During the winter period (from October 1st to March 31st), quiet hours are from 15:30 pm to 17:30 pm and from 22:00 pm to 07.30 am. For any failure to comply with Greek law, you and/or your guests shall be solely responsible.

You accept responsibility for any loss or damage to the property or adjacent properties, caused by you or your guests. The security deposit mentioned above covers any damage, loss or breakage to the property or contents.

Refrain from engaging into gambling or acts that violate public order and morals inside the Villas.

Do not distribute advertisement goods or sell articles to the other guests of the Villas or collect donation or signatures from them inside the Casa Botanica Antiparos premises, without proper permission.

Kindly note that we may refuse accommodation to patients suffering from a contagious disease/illness that may cause discomfort of any kind to the other guests inside the Villas.

Casa Botanica Antiparos reserves the right to charge the cost of rectifying/repairing damage/replacing damage caused by the deliberate/intentional, negligent or reckless act of the guest/’s to the Villa or it’s structures and furniture/decorations/equipment. Should this damage come to light after the guest has departed the Villas, we reserve the right to make a charge to the guest’s credit/debit card or send an invoice for the amount to the registered address. We will however make every effort to rectify any damage internally prior to contracting specialists to undertake the repairs and will make every effort to keep any costs that the guest would incur to a minimum. Casa Botanica Antiparos shall take photographs of all damages for evidence for both parties.

Casa Botanica Antiparos reserves the right to charge guests the cost of replacing any items that are removed from the premises by them without our prior expressed consent. The charge will be the full replacement cost of the missing item/s, including any shipping/transport/taxes/customs duties charges that may arise. Should the fact that the item(s) is missing come to light after the guest has departed the property, Casa Botanica Antiparos reserves the right to make a charge to the guest’s credit/debit card or send an invoice for the amount to the registered address submitted by the guest.

11. TOILETS

Toilet paper should not be deposited in the toilets. This may cause a blockage of the sewage system and may incur a cost to rectify (which you will be asked to bear) and well as extreme inconvenience on the part of the Guests.

12. ILLEGAL SUBSTANCES

Casa Botanica Antiparos has a zero-tolerance policy on drugs. Use and/or storage of illegal substances is strictly prohibited in the Villas. In the event of such transgression, Casa Botanica Antiparos has the right to notify the competent authorities and terminate your accommodation.

13. ENTERTAINING AT THE PROPERTY

Entertainment parties and functions involving a larger number of invitees exceeding the maximum number of guests outlined in the booking form are strictly prohibited unless fully approved by the Owning Company in advance and in writing and notified to us (venue fees may apply). Should you make an unauthorized use of the property in such a way, the Owning Company has the right to ask all guests to vacate the property immediately, with 100% penalty of the holiday rental costs paid to us. Your security deposit will be fully also forfeited until all applicable claims are fully assessed by the property owner.

14. ACCESSIBILITY

Unfortunately, our Villas cannot accommodate people with disabilities. However, we are currently working to update the constructional status of our Villas with the proper facilities in order to be able to provide accommodation to disabled guests in the near future.

15. GUEST INJURY DISCLAIMER

We cannot be held responsible for any accident or injuries occurred to all guests during their stay at the property under any circumstances.

16. CHILDREN POLICIES

Children are generally accepted in our properties. However, it is your duty to notify us if there will be any children (and their exact age) in the Party before finalizing any booking with us. You are strongly advised never to leave your children unattended. Children must be always supervised by a responsible adult.

17. PETS

Pets are welcomed in our properties. If you want to bring one with you, please check with us first before finalizing any booking.

Nevertheless, kindly be informed that exotic pets (snakes, spiders, lizards etc) are not accepted to our Villas.

An extra-cleaning fee of 150,00 euro is applicable for cleaning-purifying the Villa you reside in with your pet as fur-balls and other allergens are expected to be found

18. SWIMMING POOL

Swimming pools by their very nature carry their own inherent risks. You must ensure that you and all members of your Party take great care when using or being near any of our swimming pool(s). You should for example make sure you and all members of your party are aware of the depth(s) (including the location of any change of depth) and layout of the pool (including infinity edges) by physically checking it prior to use. All persons should walk rather than run around or near the pool and read the pool notices and our health and safety recommendations on our website. You must ensure that no-one dives into the pool at any time or enters it while under the influence of alcohol. You must check the pool every day before use and report any apparent defects. Children must be always supervised by a responsible adult. Casa Botanica Antiparos has no liability for any death or personal injury arising from use of or connected with the swimming pool.

Guests assume full responsibility for the use in or around swimming pools. In case of accident, injury or death. The Guests waive any future claim against the Property-Owning Company. If your rental period is before 01 June or after 01 October, please check with us if the swimming pool is operational.

PLEASE NEVER LEAVE CHILDREN UNATTENDED AROUND OR INSIDE THE SWIMMING POOL. The swimming pool will be kept clean and fully operational during guests stay. For health and safety reasons, the following rules must be respected:

• Diving is strictly prohibited in the pool.

• Children should be continuously supervised when playing around or inside the pool.

• The Guest and his party, including children, are strongly advised not to run around the pool with wet feet as floors may become slippery.

• We kindly advise the guests to take a quick shower at the pool shower before entering the swimming pool if tanning oils are used since they influence the water hygiene.

• The swimming pool must be kept clean from foreign materials (food, cans etc.).

19.  GROUNDS & TERRANCES

Our Villas are situated in large, partially unfenced, grounds and as such your Party must take great care when exploring these. The grounds may contain drops and/or uneven grounds that carry their own inherent risks and therefore children would need to be supervised.

Our Villas also have balconies and/or terraces many of which are accessed up steep, narrow, staircases and may feature drops and other risks. These may not be suitable for people with limited mobility. Please take extra care when using these and ensure that children are never left unsupervised and must not be allowed to climb on any railings or walls. We no liability for any death or personal injury arising from the use of or connected with the terrace(s).

20. INCLUDED MAID SERVICE

All our Villas include in your holiday costs the maid service, as stated in the booking form. The Villa will be cleaned at the beginning of the rental period before your arrival and every 3 days while your accommodation lasts. Linen & towels change are also provided every 3 days.

However, guests should leave the property in acceptable condition at the time of their departure. If the property is not left in an acceptable condition the sum of EUR 500 will be deducted from the security deposit paid.

21. EXTRA MAID SERVICE

Should you require extra maid service, please let us know at the time of booking, so that we can arrange such service. Extra charges can be quoted and included into your Holiday Rental cost and in your booking form. Should you require this extra service while already residing at the Villa, we cannot guarantee availability at any time, but we will do our utmost to satisfy your request. Any quoted charges arranged locally must be paid locally and in advance.

22. CONCIERGE SERVICES

All our Villas include a local complimentary concierge service, which consist in greeting you at the Villa, assist you during the Check-In and Check-Out procedure and being generally available for you during your stay at our Villas.

Should you require any extra services while already residing at our Villas, please contact our local concierge contact. We cannot guarantee availability at any time, but we will do our utmost to satisfy your request. Any quoted charges arranged locally must be paid locally and in advance.

23. WATER AND ELECTRICITY

Kindly note that our villas are located on a small island with a severe problem of drought. Therefore, water is a commodity to be used sparingly during the summer months. If you experience a shortage of water, we will do everything we can in time to reestablish its supply. Electricity can also be disrupted, normally for a short period of time. However, we cannot be held responsible for any inconvenience created by events beyond our control. Guests are expected to conserve water & energy. Please turn off lights, fans, stoves, air conditioners, water heaters, TVs unless really needed! Water is a precious resource in Greek Islands; use it, but do not abuse it.

24. INTERNET SERVICE

Kindly note that our villas include Internet services. However, we cannot be held responsible for any technical problem beyond our control, such as a faulty line from the local telephone company.

25. PHOTOGRAPHY

Photographs or videos taken at the Villas cannot be used or sold for profit or commercial activities without prior written authorization from us.

26. SMOKING

The Villas have a non-smoking policy indoors and the guests are kindly requested to strictly comply with it and avoid smoking indoors as it is strictly prohibited

When smoking outside, the guests are kindly requested to use the special, windy safe, ashtrays provided since there is always risk of fire during the summer.

Indoor smoking is strictly prohibited in establishment.

Should you or a member of your party do not comply with this rule, or should any upholstery be found damaged by smoking anywhere, we reserve the right to charge a minimum fee of 500,00 euro for cleaning the environment and/or replace its contents.

27. VALUABLES AND SECURITY

Valuables left at the property are at the Clients' risks.

We cannot be held responsible for their loss, misplacement, or robbery at any time. You are fully responsible for any valuables left at the property.

Casa Botanica Antiparos and the Staff cannot be held responsible for items lost/misplaced/stolen in the property. If provided, safes should be used, and suitable care should be taken against theft and burglary. You should make sure to have all doors and windows closed and locked when leaving the accommodation or when being in the grounds.

28. FORCE-MAJEURE

We shall not be liable for any default or delay in the performance of our responsibilities under this agreement if and to the extent such default or delay is caused, directly or indirectly, by fire, flood, earthquake, hurricane, drought, ocean phenomena, elements of nature or acts of God, riots, strikes, civil disorders, quarantine restrictions, epidemics, pandemics, or any other cause beyond the reasonable control of such party.

29. INDEMNIFICATION

We are not liable for any delays, accidents, damages, injuries, losses or death suffered by you, your guests.

In no event whatsoever we can be held liable for any indirect, punitive, incidental, special or consequential damages arising out of or in any way connected with your accommodation.

If, despite the limitations contained herein, the Company or its Affiliates are found liable for any loss or damage which arises out of or in any way connected with any of the occurrences described herein, then the Company’s or its Affiliates’ liabilities will in no event exceed the total related rental revenue paid by you at the time of the occurrence. Following your booking, the Company may offer to help, coordinate or organize certain guest services for you in connection with your property rental. The service providers are independent contractors and are not agents, representatives or employees of the Company. The Company and its Affiliates are not liable for the acts, errors, omissions, representations, warranties, breaches or negligence of any such service provider or for any personal injuries, property damage or other damages or expenses relating thereto.

To the extent permitted by mandatory Law, we’ll only be liable for costs you incur as a direct result of a failure on our behalf. This means, to the extent permitted by law, we won’t be liable for (e.g.) any indirect loss or indirect damage, inaccurate information about a Service Provider, mistake in an email address, phone number or credit card number (unless it’s our fault), force majeure or event beyond our control.

If you are in breach of these Terms, to the extent permitted by law we won’t be liable for any costs you incur as a result, and you won’t be entitled to any refund.

To the extent permitted by Law, the most that we cover will be liable for (whether for one event or a series of connected events) is the cost of your Booking, as set out in your confirmation email.

Nothing in these terms will limit our liability in respect of our (or their) own (i) negligence that leads to death or personal injury or (ii) fraud or fraudulent misrepresentation.

We don’t make any promises about additional services apart from what we expressly state in these Terms. Making the right choice(s) is entirely your responsibility.

30. CONFIDENTIAL INFORMATION

Our Clients’ Information is strictly confidential and is for the sole intended use of contracting our business for our Villas. Any attempts to use this confidential information outside of its intended use are strictly prohibited by law.

Notwithstanding the foregoing, Confidential Information shall not include any information to the extent it

  1. is or becomes a part of the public domain through no act or omission on the part the receiving party,

  2. is disclosed to third parties by the owner without restriction on such third parties,

  3. is in the receiving party’s possession, without actual or constructive knowledge of an obligation of confidentiality with respect thereto, at or prior to the time of disclosure under this Terms,

  4. is disclosed to the receiving party by a third party having no obligation of confidentiality with respect thereto,

  5. is independently developed without access or reference to the disclosing party’s Confidential Information, or

  6. is released from confidential treatment by written consent of the disclosing party.

31. LEGAL COMPLIANCE

You shall comply with all applicable domestic and international laws, statutes, ordinances, and regulations regarding your use of our service.

32. LAW & JURISDICTION

Any dispute or claim arising out of or in connection with your holiday rental booking with us shall be governed by and construed in accordance with the laws of the Hellenic Republic and shall be settled by the Courts of Athens, Greece.
